父母婚前买房离婚怎么分 |

如果婚前一方父母全款资助子女购房，产权登记在子女名下，该房产为个人财产不参与离婚财产分割，但赠与除外。如果产权登记在双方或另一方名下，应认定为夫妻共同财产，在离婚时进行分割，父母资助买房的一方可按规定要求分割房屋。
法律分析
婚前购房时，若一方父母全额资助子女买房，且产权登记在子女名下，则该房屋属于登记方的婚前个人财产，不参与离婚财产分割，但父母明确表示赠与双方的除外。但若婚前一方父母全款资助子女买房，即使产权登记在双方或另一方名下，在离婚时房产应视为夫妻共同财产，需要进行分割。父母资助购房的一方有权利按照规定要求分割房屋。
法律依据
《最高人民法院关于适用婚姻家庭编的解释(一)》第二十九条
当事人结婚前，父母为双方购置房屋出资的，该出资应当认定为对自己子女个人的赠与，但父母明确表示赠与双方的除外。
当事人结婚后，父母为双方购置房屋出资的，依照约定处理；没有约定或者约定不明确的，按照民法典第一千零六十二条第一款第四项规定的原则处理。
