宅基地有房产证么 |

宅基地是可以有房产证的。但是前提必须是建的合法房屋。因为按照国家有关规定，只有依法利用宅基地建造的村民住房，以及依法利用其它集体建设用地所建造房屋，是可以依照规定规定申请房屋登记。
农村的宅基地没有产权证，因为根据我们国家法律当中明确地规定，宅基地使用权仅仅是一种居住的使用的权利，一般情况下是由乡政府颁发，乡政府的产权只能够进行居住，并不能够将房屋买卖。
在农村的宅基地，如果想要办理房产证，那么具体的方法步骤有以下这几点：
1.登记申请书、申请人的身份证明、宅基地使用权证明或者集体所有建设用地使用权证明、申请登记房屋符合城乡规划的证明、房屋测绘报告或者村民住房平面图、其他必要材料。若是申请村民住房所有权初始登记的，还应当提交申请人属于房屋所在地农村集体经济组织成员的证明。
2.申请人先书面提出申请，然后提交以上所需的材料。
3.提交完所有的材料后，工作人员会受理，然后发布公告，审核。缴纳相关收费，然后记载于登记簿，就可下发证书了。

第三百六十二条宅基地使用权人依法对集体所有的土地享有占有和使用的权利，有权依法利用该土地建造住宅及其附属设施。
第三百六十三条宅基地使用权的取得、行使和转让，适用土地管理的法律和国家有关规定。
