释义	如果支付的是“定金”而不是“订金”,现在不按合同履行相关约定,是不能退还的。“定金”指为保证合同的履行,消费者预先向商家交纳一定数额的钱款。依据相关规定,商家违约时,“定金”双倍返还;消费者违约时,“定金”不返还。“定金”的总额不得超过合同标的的20%。法律依据: 《中华人民共和国民法典》第五百七十七条当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
