释义	违法。所谓走账合同，就是只接受和开具发票，有资金流动，没有实际业务发生，是虚假合同的一种。为避免这种合同带来的风险，最好不签；如果必须要签，也要按照正规工程分包的合同签订，组织相关的项目文件，材料明细，验收报告等等。法律依据《民法典》第一百四十三条规定，具备下列条件的民事法律行为有效：（一）行为人具有相应的民事行为能力；（二）意思表示真实；（三）不违反法律、行政法规的强制性规定，不违背公序良俗。
