释义	法律分析：经审理认为不属民事纠纷案件而有犯罪嫌疑的，应当裁定驳回起诉，将有关材料移送公安机关或检察机关。民事法官并不需要保证这个线索绝对的构成刑事犯罪，只要有可能构成刑事犯罪就行。法律依据：《关于公安机关办理经济犯罪案件的若干规定》第二十三条人民法院在办理民事案件过程中，认为该案件不属于民事纠纷而有经济犯罪嫌疑需要追究刑事责任，并将涉嫌经济犯罪的线索、材料移送公安机关的，接受案件的公安机关应当立即审查，并在十日以内决定是否立案。公安机关不立案的，应当及时告知人民法院。
