释义	法律分析：死者的债务，由其遗产偿还。由继承人在其所继承的遗产范围内承担清偿义务。如果全部遗产不足以清偿债务，在用遗产偿还之后，对剩下的债务，继承人没有义务代替偿还。当然，继承人如果自愿为死者偿还超过遗产实际价值的那部分债务，法律也是允许的。法律依据：《中华人民共和国民法典》第一千一百六十一条继承人以所得遗产实际价值为限清偿被继承人依法应当缴纳的税款和债务。超过遗产实际价值部分，继承人自愿偿还的不在此限。继承人放弃继承的，对被继承人依法应当缴纳的税款和债务可以不负清偿责任。
