释义	在我国并没有婚姻诈骗罪的规定，也就没有所谓的立案标准了在骗婚的案件中，通常的做法是以合法形式掩盖非法目的的民事行为为无效民事行为的规定来处理，宣告婚姻无效。被骗人可以民事行为无效为由请求返还财产。如果另一方的诈骗行为是非法占有为目的，用虚构事实或者隐瞒真相的方法，骗取数额较大的公私财物的行为，涉嫌诈骗罪。有证据证明存在诈骗事实，且金额达3千以上的，可以报案处理。诈骗的一方需要承担相应的刑事责任。
