释义	法律分析：本罪是行为犯罪，只要行为人在明知自己患有严重性病的情况下，故意实施了卖淫、嫖娼行为，即构成犯罪。至于实际上是否已造成将性病传染给他人的结果，不影响本罪的成立。当然，假如行为人的卖淫嫖娼行为确已引起他人染上性病的后果，可以作为量刑的情节予以考虑。法律依据：《刑法》第三百六十条明知自己患有梅毒、淋病等严重性病卖淫、嫖娼的，处5年以下有期徒刑、拘役或者管制，并处罚金。
