释义	法律分析：具有人身性质的民事行为不能代理。如设立遗嘱、婚姻登记、收养子女等。一般情况下，所有的民事法律行为，都可以代理。事实行为、不法行为不属于代理制度范围，法律对于法律行为以外的其他行为使用代理的概念，也不属于代理制度的适用范围，比如代理记账行为，虽然会计法有明确的代理记账业务规定。法律依据：《中华人民共和国民法典》第一百五十三条违反法律、行政法规的强制性规定的民事法律行为无效。但是，该强制性规定不导致该民事法律行为无效的除外。违背公序良俗的民事法律行为无效。
