释义	法律分析: 遗产已被分割而未清偿债务时，如有法定继承又有遗嘱继承和遗赠的，首先由法定继承人用其所得遗产清偿债务；不足清偿时，剩余的债务由遗嘱继承人和受遗赠人按比例用所得遗产偿还；如果只有遗嘱继承和遗赠的，由遗嘱继承人和受遗赠人按比例用所得遗产偿还。法律依据: 《中华人民共和国民法典》第一千一百六十一条继承人以所得遗产实际价值为限清偿被继承人依法应当缴纳的税款和债务。超过遗产实际价值部分，继承人自愿偿还的不在此限。继承人放弃继承的，对被继承人依法应当缴纳的税款和债务可以不负清偿责任。
