释义	法律分析：鉴定人做出了与自己的知识或技能所得到的结论相反的结论。伪证罪的一种。构成本罪主观上必须具有意图陷害他人或者隐匿罪证的故意，由于不了解情况，或粗心大意、业务水平低，而提供了错误的鉴定，不构成本罪。客观上表现为在刑事诉讼中，对与案件有重要关系的情节，故意提供虚假材料和意见，作虚假的鉴定。法律依据：《中华人民共和国刑事诉讼法》第一百四十七条鉴定人进行鉴定后，应当写出鉴定意见，并且签名。鉴定人故意作虚假鉴定的，应当承担法律责任。
