释义	根据刑法规定，拐骗儿童罪既遂的量刑标准有：拐骗不满十四周岁的未成年人，脱离家庭或者监护人的，处五年以下有期徒刑或者拘役。该罪的主体是满十六岁的具有完全刑事责任能力的人构成的。【法律依据】《刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第二百六十二条拐骗不满十四周岁的未成年人，脱离家庭或者监护人的，处五年以下有期徒刑或者拘役。
