释义	战时拒绝军事征用，涉嫌下列情形之一的，应予立案追诉：（一）无正当理由拒绝军事征用三次以上的；（二）采取暴力、威胁、欺骗等手段拒绝军事征用的；（三）联络、煽动他人共同拒绝军事征用的；（四）拒绝重要军事征用，影响重要军事任务完成的；（五）其他情节严重的情形。【法律依据】《刑法》第三百八十一条，战时拒绝军事征收、征用，情节严重的，处三年以下有期徒刑或者拘役。
