释义	法律分析：新刑法对投敌叛变罪的量刑标准为处三年以上十年以下有期徒刑，或者十年以上有期徒刑或者无期徒刑，可以并处没收财产。携带武器或国家秘密投敌叛变的；胁迫他人与其一同叛变的，高级官员或负有重要职责的人员(如机要人员)叛变的，等等，是本罪的加重处罚事由。法律依据：《中华人民共和国刑法》第一百零八条投敌叛变的，处三年以上十年以下有期徒刑；情节严重或者带领武装部队人员、人民警察、民兵投敌叛变的，处十年以上有期徒刑或者无期徒刑。
