释义	无产权证但属于合法建筑的房屋可以签订租赁合同。对于历史遗留的无证小产权房可以进行出租，租赁合同应认定为有效；但对于违章建筑、超期的临时建筑、无证小产权房等没有任何合法手续的非法建筑物不得出租，租赁合同无效。【法律依据】《商品房屋租赁管理办法》第六条有下列情形之一的房屋不得出租：（一）属于违法建筑的；（二）不符合安全、防灾等工程建设强制性标准的；（三）违反规定改变房屋使用性质的；（四）法律、法规规定禁止出租的其他情形。
