释义	法律分析：拘役指短期剥夺罪犯人身自由，就近拘禁并强制劳动的刑罚。刑期短于有期徒刑，由公安机关就近执行。服刑期间，被处拘役者每月可回家1到2天，参加劳动者还可酌量发给报酬。拘役期满后再犯罪，不构成累犯。拘役的刑期，从判决执行之日起计算；判决前先行羁押的，羁押1日折抵刑期1日。法律依据：《中华人民共和国刑法》第四十三条被判处拘役的犯罪分子，由公安机关就近执行。在执行期间，被判处拘役的犯罪分子每月可以回家一天至两天；参加劳动的，可以酌量发给报酬。
