释义	对于第三人申请参加仲裁是依据《仲裁法》第四条当事人采用仲裁方式解决纠纷，应当双方自愿，达成仲裁协议。没有仲裁协议，一方申请仲裁的，仲裁委员会不予受理。从该条中可以看到，商事仲裁和法院诉讼是完全不同的发起方式。商事仲裁必须双方达成仲裁协议，仲裁委员会才能受理。所以，仲裁中是不可能出现承担仲裁裁决义务的第三人。道理很简单，如果仲裁涉及第三人，第三人只有和当事人双方补签仲裁协议，仲裁委才能将第三人合并进来一起仲裁。否则，如果第三人不同意参加仲裁，仲裁委员会是不能强行对其仲裁。
