释义	法律分析: 市场主体被起诉的，在诉讼期间可以注销营业执照。但在进行诉讼的过程中，市场主体未经清算就办理注销登记，事后债权债务查证属实的，则该市场主体的股东或其他负责人应当在债权人主张的债务范围内，承担相应的赔偿责任。《中华人民共和国市场主体登记管理条例》第三十一条市场主体因解散、被宣告破产或者其他法定事由需要终止的，应当依法向登记机关申请注销登记。经登记机关注销登记，市场主体终止。市场主体注销依法须经批准的，应当经批准后向登记机关申请注销登记。
