释义	法律分析: 法院判决书下来了就不能撤诉了。但是，可以上诉后再撤回一审起诉。在第二审程序中，原审原告申请撤回起诉，经其他当事人同意，且不损害国家利益、社会公共利益、他人合法权益的，人民法院可以准许。《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》第三百三十八条在第二审程序中，原审原告申请撤回起诉，经其他当事人同意，且不损害国家利益、社会公共利益、他人合法权益的，人民法院可以准许。准许撤诉的，应当一并裁定撤销一审裁判。原审原告在第二审程序中撤回起诉后重复起诉的，人民法院不予受理。
