释义	离婚的方式有两种，一种是去民政局协议离婚，另一种是去法院诉讼离婚。其中去民政局协议离婚只适用于双方已经就一切事宜达成共识;而选择离婚的情况，去法院诉讼离婚则适用于一方不同意离婚或财产分割、子女抚养有争议的情况。一方不同意能离婚，离婚方式采用诉讼离婚的形式，即直接向人民法院提出离婚诉讼。【法律依据】《民法典》第一千零七十九条，夫妻一方要求离婚的，可以由有关组织进行调解或者直接向人民法院提起离婚诉讼。人民法院审理离婚案件，应当进行调解;如果感情确已破裂，调解无效的，应当准予离婚。
