发布部门:最高人民法院发布文号:上海市高级人民法院：你院（74）沪高法民字第293号请示收悉。我们认为，关于钱行仪与吴章明离婚一案，应由你市有关法院根据我国法律另行判决，香港法院判决不予承认。此复.附：上海市高级人民法院关于港澳判决离婚案件执行的请示报告(一九七四年四月十九日（74）沪高法民字第293号)最高人民法院：最近，我们在处理港澳婚姻案件中，发现有个别在香港的一方向香港法院提出离婚，香港法院判决离婚，但判决书没寄给上海一方。例如：吴章明（男）与钱行义（女）于一九五三年结婚，生有二个孩子，一九六二年钱去香港，至六五年钱要求与吴离婚，但吴不同意，钱即向香港法院起诉，并于一九六八年十二月十九日判决双方离婚生效，而吴在上海未收到书面判决。直到一九七三年才听儿子告诉以上情况，才要来一份判决。为此，吴向本市静安区法院提出办理离婚手续，对香港法院的判决应否承认，还是上海另行判决，对此，我们没有把握，特请示。.
