释义	公司破产了公司监事承要不要担责任依据我国企业破产法的规定，公司破产后公司的监事要不要承担责任，由实际情况而定，在看公司的监事是否侵害公司的利益。《中华人民共和国企业破产法》第三十六条债务人的董事、监事和高级管理人员利用职权从企业获取的非正常收入和侵占的企业财产，管理人应当追回。第一百二十五条企业董事、监事或者高级管理人员违反忠实义务、勤勉义务，致使所在企业破产的，依法承担民事责任。有前款规定情形的人员，自破产程序终结之日起三年内不得担任任何企业的董事、监事、高级管理人员。
