法律分析：
自愿给钱并不是不构成诈骗的理由。诈骗在法律上的定义是“虚构或隐瞒事实，骗取钱财、非法占有”。所以，所有的诈骗罪在受害人给钱时都是主动给付的，只不过是被骗情况下的主动给付，以对方自愿给钱为由，并不能构成对诈骗罪的抗辩。
法律依据：
《中华人民共和国刑法》第二百六十六条 诈骗罪是指以非法占有为目的，用虚构事实或者隐瞒真相的方法，骗取数额较大的公私财物的行为。
