释义	如果是公民个人私自买烟，只是供本人使用的，不构成犯罪，不会受到处罚。但是如果公民未取得烟草专卖许可证的，私自买烟，之后又倒卖给他人，会受到行政处罚，如罚款、没收违法所得等；情节严重的，构成非法经营罪，会依法追究刑事责任。法律依据：《中华人民共和国烟草专卖法》第三十五条：倒卖烟草专卖品，构成犯罪的，依法追究刑事责任；情节轻微，不构成犯罪的，由工商行政管理部门没收倒卖的烟草专卖品和违法所得，可以并处罚款。烟草专卖行政主管部门和烟草公司工作人员利用职务上的便利犯前款罪的，依法从重处罚。
