父母生而不养子女要履行赡养义务吗 |

父母没有尽到养育孩子的责任，在年老后子女仍然有赡养父母的义务。
抚养义务与赡养义务是两个法律关系。如果出现父母对子女不履行抚养义务的，子女有权向父母主张履行抚养义务或支付抚养费，但是却不能因为父母未尽抚养义务而对抗赡养义务。
子女对父母有赡养的义务，这是法定义务，子女不能以任何理由拒绝履行，子女不履行赡养义务时，无劳动能力或生活困难的父母，有要求子女给付赡养费的权利。
父母对未成年子女的抚养义务，成年子女对父母的赡养义务，均是法定义务，不能附加任何条件。父母和子女之间的法定义务是基于他们之间的身份关系而产生的，不能简单地用等价有偿、公平和平的一般民法理念来衡量。
但在特殊情况下，可以免除子女对父母的赡养义务。
《中华人民共和国民法典婚姻家庭编继承编理解与适用》对这一问题有简答的解答，“我们认为，如果父母确因经济能力或者其他客观原因（比如因犯罪被监禁）未能履行抚养义务，子女成年后主张免除赡养义务的，法院不予支持……如果父母具有抚养能力而拒不履行抚养义务或者对子女实施虐待、遗弃、故意杀害能行为，情节严重的，可以免除子女的赡养义务。”从这段话可以看出，如果仅仅是父母具有抚养能力而拒不履行抚养义务，并不属于“情节严重”的，法院并不会支持子女免除赡养义务。
所谓“情节严重”，应当是因为父母拒不履行抚养义务这一行为而给子女的生活、教育造成了严重不良后果，比如说因为父母拒绝履行抚养义务而使子女无法及时就医造成其身体健康受到严重伤害的，再或者说因为父母多次拒绝履行抚养义务而使子女的心理、精神健康受到严重伤害的等等。总之，何为“情节严重”，需要在个案中由法官根据案件事实及相关证据，来综合评判。
【法律依据】
《民法典》第一千零六十七条，父母不履行抚养义务的，未成年子女或者不能独立生活的成年子女，有要求父母给付抚养费的权利。
成年子女不履行赡养义务的，缺乏劳动能力或者生活困难的父母，有要求成年子女给付赡养费的权利。
