法律分析:因标的房屋被依法纳入政府拆迁改造范围,双方当事人在此之后所签订的房屋买卖合同无法办理房屋产权变更登记手续,该标的房屋的所有权人仍为卖方。考虑到所购房屋物权因拆迁而消灭,买方已无法取得标的房屋的产权。卖方作为标的房屋的所有权人,其所签订的国有土地上房屋征收补偿协议书,合法有效。
法律依据:《中华人民共和国民法典》第二百零八条
不动产物权的设立、变更、转让和消灭,应当依照法律规定登记。动产物权的设立和转让,应当依照法律规定交付。
