释义	法律分析: 不算服刑，但是可以折抵。如果最后判的是管制，那么羁押一天折抵刑期两天，因为管制比较轻；拘役和有期徒刑都是羁押一天折抵刑期一天；无期徒刑和死刑不折抵。但是注意，侦查期间如果不是被羁押的，那就不折抵。不是折抵侦查的期间，而是折抵在判刑之前已经被关进去的时间。法律依据: 《中华人民共和国刑法》第四十七条有期徒刑的刑期，从判决执行之日起计算；判决执行以前先行羁押的，羁押一日折抵刑期一日。
