释义	法律分析：扶养专指夫妻之间，因此法定扶养人一般是指夫妻。但是法律还有特别的规定，即法定扶养人还包括无法定扶养义务人，或者虽有法定扶养义务人，但是扶养义务人无扶养能力的，无劳动能力的，无生活来源的，而法定扶养义务人是指依照婚姻法规定负有扶养、抚养和赡养义务的人。因此法定扶养人一般指夫妻，除此之外一般要有法定权利来源。法律依据：《中华人民共和国民法典》第一千零四十一条婚姻家庭受国家保护。实行婚姻自由、一夫一妻、男女平等的婚姻制度。保护妇女、未成年人、老年人、残疾人的合法权益。
