释义	符合下列要件即可确定构成组织黑社会性质组织罪： 1、犯罪主体为一般主体； 2、主观方面表现为故意； 3、犯罪客体是社会治安管理秩序； 4、客观方面表现为组织以暴力威胁或者其他手段，有组织地进行违法犯罪活动的黑社会性质的组织的行为。【法律依据】《刑法》第二百九十四条组织、领导黑社会性质的组织的，处七年以上有期徒刑，并处没收财产；积极参加的，处三年以上七年以下有期徒刑，可以并处罚金或者没收财产；其他参加的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利，可以并处罚金。
