释义	法律分析：我国民法典没有明确规定职务侵权的表现形式，但是对法人职务行为的法律后果的承担做出了明确的规定。并且规定，法定代表人履行职务活动时，造成他人损失的，由法人承担民事责任。法律依据：《中华人民共和国民法典》第六十二条法定代表人因执行职务造成他人损害的，由法人承担民事责任。法人承担民事责任后，依照法律或者法人章程的规定，可以向有过错的法定代表人追偿。第六十三条法人以其主要办事机构所在地为住所。依法需要办理法人登记的，应当将主要办事机构所在地登记为住所。
