我国刑法中的基本原则有?

释义

法律主观：

刑法的基本原则有： 1、罪刑法定原则：法无明文不为罪，法无明文不处罚。 2、刑法适用平等原则：对任何人犯罪，在适用法律上一律平等。不允许任何人有超越法律的特权。对于一切人的合法权益都要平等地加以保护，不允许有任何歧视。 3、罪责刑相适应原则：刑罚的轻重应当与犯罪的轻重相适应。

法律客观：

《刑法》第三条，法律明文为犯罪行为的，依照法律定罪处刑；法律没有明文为犯罪行为的，不得定罪处刑。
