释义	法律分析：胁从犯是指在共同犯罪中被胁迫参加犯罪的人，胁从犯是我国刑法的独特体例。它有两个特征:一是在主观上行为人虽然明知自己实施的行为是共同犯罪行为，但从其内心而言，行为人本不愿意或不完全愿意参与共同犯罪，只是由于受到他人的暴力威胁才参加了共同犯罪。二是在客观上行为人虽然参与了共同犯罪的实施，但是其犯罪行为显得比较消极，缺乏积极主动精神。法律依据：《中华人民共和国刑法》第二十八条对于被胁迫参加犯罪的,应当按照他的犯罪情节减轻处罚或者免除处罚。
