释义	刑事犯罪的刑事职责年纪无上限限定，只要构成犯罪都会追究刑事职责并执行刑罚。对一定年纪的老人(生活自理本领障碍者)会本着人道主义原则予以宽济处罚，但“以特别残忍手段使人丧命的罪犯”除外。法律依据：《中华人民共和国刑法》第十七条之一已到七十五岁的人有意犯罪的，能够从轻或者减轻处罚失犯罪的，应当从轻或者减轻处罚。第四十九条犯罪的时候不满十八周岁的人和审判的时候怀孕的妇女，不适用死刑。审判的时候已满七十五周岁的人，不适用死刑，但以特别残忍手段致人死亡的除外。
