释义	法律分析：移送审查起诉管辖权一般都是被告所在地的人民法院，检察院受理同级公安机关移送审查起诉的案件，经审查认为属于上级人民法院管辖的第一审案件时，应当写出审查报告，连同案卷材料报送上一级检察院，同时通知移送审查起诉的公安机关。法律依据：《中华人民共和国民事诉讼法》第三十六条人民法院发现受理的案件不属于本院管辖的，应当移送有管辖权的人民法院，受移送的人民法院应当受理。受移送的人民法院认为受移送的案件依照规定不属于本院管辖的，应当报请上级人民法院指定管辖，不得再自行移送。
