释义	招摇撞骗罪不是数额犯。犯罪分子存在冒充国家机关工作人员招摇撞骗的行为，应当立案侦查。招摇撞骗罪侵犯的客体是国家机关的威信及其正常活动，属于行为犯。【法律依据】《中华人民共和国刑法》第五条刑罚的轻重，应当与犯罪分子所犯罪行和承担的刑事责任相适应。第二百七十九条冒充国家机关工作人员招摇撞骗的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利；情节严重的，处三年以上十年以下有期徒刑。冒充人民警察招摇撞骗的，依照前款的规定从重处罚。
