释义	法律分析：证人作证能力，是指向司法机关提供证言的证人必须具备的能力。包括：（1）对案件事实和情节的感知能力。（2）证人对案件事实和情节的记忆能力。（3）证人对案件事实和情节的陈述能力。不能正确表达意思的人，不能作为证人。法律依据：《最高人民法院关于民事诉讼证据的若干规定》第六十七条不能正确表达意思的人，不能作为证人。待证事实与其年龄、智力状况或者精神健康状况相适应的无民事行为能力人和限制民事行为能力人，可以作为证人。
