需要的。企业跟员工在劳动合同约定实行弹性工作制或者不定时工作制，或者在制度里规定了，但却没有提前的审批备案，实际上这种弹性工作制也很可能会被视为无效。
法律依据：
《中华人民共和国劳动合同法》 第四十一条 延长工作时间必须符合《劳动法》的有关规定，每日不得超过1小时；特殊原因需要延长工作时间的，在保障劳动者身体健康的条件下延长工作时间每日不得超过3小时，但每月不得超过36小
时。
