释义	法律分析：雇凶杀人，属共同犯罪，雇凶的人和被雇的人都是主犯，其社会危害性相同。所谓雇凶杀人属故意杀人罪，虽然其本人没有亲自参与杀人的行为，但行为人是在其授意的情况下才有所作为的，雇佣者本人具有严重的社会害危性，在整个犯罪过程中是主谋，故该种犯罪一般会判除死刑。法律依据：《中华人民共和国刑法》第二百三十二条故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。
