释义	法律分析：宣判之前原告是可以进行撤诉处理的。侵占罪，是指以非法占有为目的，将代为保管的他人财物、遗忘物或者埋藏物非法占为己有，数额较大，拒不交还的行为。只要尚未宣判，起诉者便可以撤诉，但是能不能同意还是要人民法院来决定，如果人民法院不同意撤诉的话，那么自己就应当按时的参加开庭。法律依据：《中华人民共和国民事诉讼法》第一百四十五条宣判前，原告申请撤诉的，是否准许，由人民法院裁定。人民法院裁定不准许撤诉的，原告经传票传唤，无正当理由拒不到庭的，可以缺席判决。
