与未满14周岁的女孩(或男孩)发生性关系，不论她(他)是否自愿，均视为强奸未成年少女(少男)罪;而已满14周岁以上的不在此列。只要她精神正常，不属于无民事行为能力人，双方自愿的，不构成强奸行为。
法律依据：
《中华人民共和国刑法》 第二百三十六条 以强奸罪对犯罪嫌疑人定罪量刑，且需要承担民事赔偿责任。与明知未满14周岁的幼女发生性关系，无论该幼女是否自愿，都构成强奸。
