释义	1、民法典规定夫妻共同债务这样认定：一般来说，基于夫妻家庭共同生活的需要以及对共有财产的管理、使用、收益和处分而产生的债务，可认定为夫妻共同债务。2、如果认定为夫妻共有债务，夫妻双方都要承担责任的，都具有归还债务的义务。但如果认定为夫妻个人债务，那么无论是否有一方不知情，该债务都只需由负债的一方偿还。法律依据《中华人民共和国民法典》第一千零六十四条、第一千零八十九条
