释义	法律分析：未经竣工验收的房屋出租，房屋租赁合同无效；违章建筑的房屋出租，房屋租赁合同无效；被确定为拆迁的房屋出租，房屋租赁合同无效。合同无效或者被撤销后，因该合同取得的财产，应当予以返还;不能返还或者没有必要返还的，应当折价补偿。法律依据：《中华人民共和国民法典》第五百零七条合同不生效、无效、被撤销或者终止的，不影响合同中有关解决争议方法的条款的效力。第五百零八条本编对合同的效力没有规定的，适用本法第一编第六章的有关规定。
