农民工不签合同怎么办 -合同订立

法律分析：
在司法实践中，如果是农民工不愿意与用人单位签订劳动合同的情况下，用人单位无需支付赔偿，但是如果农民工要求签订劳动合同，用人单位拒不签订的则可以诉讼解决，用人单位必须支付两倍工资。
法律依据：
《中华人民共和国劳动合同法》 第八十二条 用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付二倍的工资。
用人单位违反本法规定不与劳动者订立无固定期限劳动合同的，自应当订立无固定期限劳动合同之日起向劳动者每月支付二倍的工资。
