释义	法律分析：如果该笔借款被认定为夫妻共同债务，那么离婚时双方应当对债务的偿还作出约定，可以约定由某一方承担，也可以约定由双方分担；如果该笔借款是夫或者妻一方的个人借款，则不属于夫妻共同债务，不管是否离婚，债务人都是该借款人个人。例外情况是，另一方是保证人，如果是这种情况，另一方需要承担相应的保证责任。法律依据：《中华人民共和国民法典》第一千零八十九条离婚时，夫妻共同债务应当共同偿还。共同财产不足清偿或者财产归各自所有的，由双方协议清偿；协议不成的，由人民法院判决。
