释义	法律分析：可以撤回上诉。在上一级法院审理上诉案件的期间，如果因为个人或他人原因要求撤回诉讼，是可以的。撤诉作为诉讼当事人的一项基本权利，应当贯穿整个诉讼阶段的始终。只要在法院的裁判文书发生效力之前，当事人向法院提出申请，都是对其享有的权利进行处置的表现，所以对二审程序中上诉人的撤诉申请法院应予准许。法律依据：《中华人民共和国民事诉讼法》第一百四十五条宣判前，原告申请撤诉的，是否准许，由人民法院裁定。人民法院裁定不准许撤诉的，原告经传票传唤，无正当理由拒不到庭的，可以缺席判决。
