释义	法院对假冒专利罪既遂的处罚规定有：情节严重的，处三年以下有期徒刑，并处或者单处罚金。该罪在主观上是故意的心态，即行为人明知自己的行为会发生侵害他人专利权的结果，且希望或者放任这种结果发生的情形。【法律依据】《刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第二百一十六条假冒他人专利，情节严重的，处三年以下有期徒刑或者拘役，并处或者单处罚金。
