专利权的强制许可的种类包括哪些 |

1、未在合理长时间取得使用权的强制许可
在这一类型下，应当具备的条件是：第一，请求人必须是具备实施条件，也就是具备生产、制造、销售专利产品或使用专利方法的基本条件；第二，请求人必须曾以合理条件与专利权人就实施其专利进行过协商，合理的条件主要是关于使用费的支付、技术服务等双方需履行的基本义务；第三，请求人没有在合理长的时间内获得专利权人的许可。
2、为国家利益或公共利益的需要给予的强制许可
在国家出现紧急状态或非常情况时，或者为了公共利益的目的，国务院专利行政部门可以给予实施发明专利或实用新型专利的强制许可。
3、从属专利的强制许可
从属专利的强制许可是基于专利间的依赖关系授予的，即“一项取得专利权的发明或者实用新型比前已经取得专利权的发明或者实用新型具有显著经济意义的重大技术进步，其实施又有赖于前一发明或者实用新型的实施”，为了促进先进专利技术的实施，有必要授予后专利权人实施前专利技术的强制许可证。同时，也应授予前专利权人实施后专利技术的强制许可证。
一、专利强制许可的前提条件
1、必须是为了不使专利妨碍第三方的合法利益而进行的限制；
2、这种限制不能与专利的正常使用冲突(包括不能损害专利“被许可使用人”的利益)；
3、这种限制不能够不合理地损害专利权人的利益。
