释义	法律分析：法律上分手费的认定是是基于男女双方民事法律行为而产生。男女双方解除恋爱、同居、婚约以及婚姻关系时，双方约定或一方自愿给付分手费的行为显然是男女双方的民事法律行为。根据2021年实施的《民法典》第一百三十七条规定，以对话方式作出的意思表示，相对人知道其内容时生效。《民法典》第一百四十三条规定，具备下列条件的民事法律行为有效：（一）行为人具有相应的民事行为能力；（二）意思表示真实；（三）不违反法律、行政法规的强制性规定，不违背公序良俗。
