释义	房地产开发资质的年检制度房地产开发企业的资质实行年检制度。对于不符合原定资质条件或者有不良经营行为的企业，由原资质审批部门予以降级或者注销资质证书。一级资质房地产开发企业的资质年检由国务院建设行政主管部门或者其委托的机构负责。二级资质及二级资质以下房地产开发企业的资质年检由省、自治区、直辖市人民政府建设行政主管部门制定办法。房地产开发企业无正当理由不参加资质年检的，视为年检不合格，由原资质审批部门注销资质证书。房地产开发主管部门应当将房地产开发企业资质年检结果向社会公布
