农村盖的车库应该认定违建？ |
| 释义 |
违法建筑是指未经规划土地主管部门批准，未领取建设工程规划许可证或临时建设工程规划许可证，擅自建筑的建筑物和构筑物。违法建筑包括：
(一)占用已规划为公共场所、公共设施用地或公共绿化用地的建筑;
(二)不按批准的设计图纸施工的建筑;
(三)擅自改建、加建的建筑;
(四)农村经济组织的非农建设用地或村民自用宅基地非法转让兴建的建筑;特区内城市化的居民委员会或股份合作公司的非农业用地非法转让兴建的建筑;
(五)农村经济组织的非农业用地或村民自用宅基地违反城市规划或超过市政府规定标准的建筑;
(六)擅自改变工业厂房、住宅和其他建筑物使用功能的建筑;
(七)逾期未拆除的临时建筑;(八)违反法律、法规有关规定的其他建筑。
法律依据：
《中华人民共和国土地管理法》 第七十六条 未经批准或者采取欺骗手段骗取批准，非法占用土地的，由县级以上人民政府土地行政主管部门责令退还非法占用的土地，对违反土地利用总体规划擅自将农用地改为建设用地的，限期拆除在非法占用的土地上新建的建筑物和其他设施，恢复土地原状，对符合土地利用总体规划的，没收在非法占用的土地上新建的建筑物和其他设施，可以并处罚款；对非法占用土地单位的直接负责的主管人员和其他直接责任人员，依法给予行政处分；构成犯罪的，依法追究刑事责任。
